Footballmentor and the websites, footballmentor.com, lockerroom.footballmentor.com, and danielpauk.dk (the “Site” and “Sites”), are a brand of PAUK PT and are registered in Denmark and operated by Daniel Pauk. The Sites and any other add-ons, applications, features, tools, and materials offered from time to time in relation to the Sites are collectively referred to here as the “Services.” Throughout the Sites, the terms “we,” “us,” and ”our” refer to Footballmentor, footballmentor.com, and Daniel Pauk. We offer our Sites and Services, including all content, tools, and services available from Footballmentor to you, the user, conditioned upon your acceptance of all terms, conditions, policies, disclaimers, and notices stated here.

We may provide links to other websites or use partner/affiliate services (the “Third-party Service” and “Third-party Services”). Footballmentor and Daniel Pauk have no control over such Third-party Services or their content and therefore make no claim or representation regarding, and expressly disclaim responsibility for, the accuracy, quality, legality, nature, availability, or reliability of these. Our terms and policies do not govern your use of any website or applications other than our Sites. By accessing, and by your continued use of our Sites and Services, you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access our Sites and Services.

The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

2. ACCEPTANCE OF TERMS AND BINDINGS

Our Terms and Conditions are a binding contract between you and Footballmentor regarding the use of the websites, associated services, and any content (“the Sites and Services”) provided by Footballmentor and Daniel Pauk. By using any part of the Services, you will agree to any terms and conditions incorporated herein by reference (collectively, these “Terms”), including, without limitation, our Cookie Policies, Privacy Statements, and Disclaimers.

By continuing to visit and use our Sites and Services, you agree to abide by and are bound by these Terms and Conditions. We reserve the right to change these Terms and Conditions at any time, and you agree under your continued use of our Services to be bound by any such changes. In addition, unless explicitly stated otherwise, any new features or functionality that augment or enhance our Sites and Services shall be subject to these Terms and Conditions. When Footballmentor makes changes, we will make the updated Terms available on our Sites and update the “Last Updated” date at the beginning of these Terms accordingly. It is your responsibility to check this page periodically for changes. Any changes to these Terms will apply on the date that they are made, and your continued access to or use of the Services after these Terms have been updated will constitute your binding acceptance of the updates. If you do not agree to any revised Terms, you may not access or use the Services.

Please be aware that certain content, products, and services are sold, hosted, and operated via third parties, including but not limited to mypthub.net. For example, MyPTHub is responsible for hosting and servicing the MyPTHub app and Footballmentor App (mobile and web), including the Footballmentor package store: footballmentor.mypthub.net.

www.mypthub.net is a website operated by Fitii Ltd, a limited company registered in England and Wales with company number 09374110 and having its registered office at Greenacre Court, Station Road, Burgess Hill, West Sussex, RH15 9DS, UK.

Please review the third-party’s policies and practices carefully and ensure you understand and acknowledge them before engaging in any service/transaction. Footballmentor and Daniel Pauk are not responsible for providing their current policies or changes thereof.

3. THIRD-PARTY LINKS AND CONTENT

Our Sites and Services may contain links, integrations, add-ons, or connections to other services that are not owned or controlled by Footballmentor. We do not monitor or review the content of other parties’ which are linked from our Sites and Services. In certain sections of the Services or through social media channels (e.g. YouTube, Instagram, Facebook, Thread, X, Discord), you may be able to post your comments and participate in discussions. For example, your friends and others who have access to view information about you on social media will be able to see that you posted a comment. Footballmentor and Daniel Pauk do not hold any legal rights of ownership of the content posted by these third parties or by the users on these Third-party Service platforms. Content created by third parties and users of the platforms is the third parties’ sole responsibility, and its accuracy and completeness are not endorsed or guaranteed by us. Your correspondence or business dealings with, or participation in promotions of, advertisers and other Users found on or through the Services and Third-party Services are solely between you and such advertiser or User. You acknowledge that by providing you with the ability to view and distribute content through our Sites and Services and Third-party Services, Footballmentor is not undertaking any obligation or liability relating to the content, and you are using the Third-party Service at your own risk. Footballmentor, its partners, and affiliates do not undertake or assume any duty to monitor the Third-party Services for incorrect, inappropriate, or unlawful content. Products or services offered by Third-party Services shall be subject to the applicable Terms and Conditions of those Third-party Services. We are not responsible for examining or evaluating the content or accuracy, and we do not warrant and will not have any liability or responsibility for any third-party materials or websites or any other materials, products, or services of third parties. 4. ACCESS AND USE OF THE SERVICES

Our Sites and custom app (Footballmentor App, a white-label MyPTHub App that is hosted/serviced by our Third-party Service provider, MyPTHub.net) are intended to serve as an educational resource for football (soccer) enthusiasts. The Footballmentor services offer in-depth insights into common football-related injuries, strategies for enhancing performance, training/nutritional programs, and tools for users to monitor and evaluate the advances in their programs and workout routines.

OUR CONTENT AND SERVICES ARE FOR EDUCATIONAL, INFORMATIONAL, AND ENTERTAINMENT PURPOSES ONLY AND ARE NOT INTENDED TO REPLACE A LICENSED PHYSICIAN’S CARE, NOR ANY CONTENT OR SERVICE BEING OFFERED FOR MEDICAL ADVICE PURPOSES. READ MORE IN OUR MEDICAL DISCLAIMER HERE

OUR SERVICES ARE NOT DIRECTED TO CHILDREN. YOU’RE NOT ALLOWED TO ACCESS OR USE OUR SERVICES IF YOU’RE UNDER THE AGE OF 18 YEARS. IF YOU REGISTER AS A USER OR OTHERWISE USE OUR SERVICES, YOU REPRESENT THAT YOU’RE AT LEAST 18 YEARS OLD. IN ADDITION, YOU MAY USE OUR SERVICES ONLY IF YOU CAN LEGALLY FORM A BINDING CONTRACT WITH US. When you set up an account on the Services, you will be asked to provide accurate and complete registration information, which may include providing a valid email address, first and last names, as well as choosing applicable usernames and passwords (collectively, “Account Info”). You understand that you are and will be fully responsible: (i) for the security of your Account Info, and (ii) for any activity that takes place on the Services using your Account Info, whether you knew about it or not. You agree to inform us immediately at contact@footballmentor.com if you become aware that your Account Info has been compromised, or used without your permission. Footballmentor cannot and will not be liable for any loss or damage arising from your failure to comply with this section.

Before you start any workouts, exercise programs, and/or nutritional programs, you are bound to sign a waiver form upon user registration inside the Footballmentor app (android, iOS, or the website access: footballmentor.mypthub.net). If you have any issues with signing the waiver electronically via the app, you can find the waiver here and send it to contact@footballmentor.com with the subject title: Signed Waiver Form. If you have any questions about the waiver, please contact us via contact@footballmentor.com.

Once you have submitted an email address to any of our Sites, the Footballmentor app, or footballmentor.mypthub.net, you authorize us to send you notices and newsletters via email. You can always unsubscribe from our newsletters via the “unsubscribe” link displayed at the bottom of all newsletter emails. Please note that it is your obligation to keep your current email address and contact information updated at all times.

Our email transactions and marketing/newsletters are handled via our Third-party Service provider Marketing/SMTP Platform: SENDINBLUE (Brevo.com). You agree that the personal data you provide via forms on our Sites and Services will be transferred to Brevo for processing in accordance with Brevo’s Privacy Policy. You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the Service is provided without express written permission by us.

We reserve the right to refuse Service to anyone for any reason at any time.

5. USER CONDUCT

As a condition of use, you agree to all of the following:

• You acknowledge that the Site, the Footballmentor app, and footballmentor.mypthub.net is for personal use only. You agree that you will not use the content and services for any commercial purposes.
• You are responsible for all activity that occurs under your name, profiles, and other online identities.
• You are solely responsible for your conduct and any Content (defined below) that you submit, post, and display on the Site or that you allow others to submit, post, and/or display on the Site under your name, profiles, and other online identities.
• You must not harass, threaten, impersonate, or intimidate other users.
• You may not misrepresent your identity or affiliation with us or any other person or entity when using any site function or Service.
• You must not upload, post, email, transmit, or otherwise make available any content that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another’s privacy, hateful or racially, ethnically, or otherwise objectionable.
• You must not upload, post, email, transmit, or otherwise make available any unsolicited or unauthorized advertising, promotional materials, “junk mail,” “spam,” “chain letters,” “pyramid schemes,” “affiliate links,” or any other form of solicitation.
• You must not transmit any worms, viruses, or code of a destructive or disruptive nature.
• You must not violate any local laws in your jurisdiction (including, but not limited to, intellectual property laws).
• You must not use the Site for any illegal or unauthorized purpose. If you are an international user, you agree to comply with all local laws regarding online conduct and acceptable content in your jurisdiction.
• You must not access, “hack,” alter, or otherwise use any part of the Site in any manner that you do not have access to or exceeds your authorized access.
• You must not utilize any bugs, robots, or other technological device to access or extract any data or information contained on our Sites or their servers.
• You agree that you will not submit copyrighted material, protected by trade secret or otherwise subject to third-party proprietary rights, including privacy and publicity rights, unless you are the owner of such rights or have permission from their rightful owner to post the material and grant us all licenses granted herein.
• You agree that you shall be solely responsible for your own content and the consequences of posting it.
• We reserve the right, in its sole and absolute discretion, to reject, refuse to post, or remove any posting by you or to restrict, suspend, or terminate your access to all or any part of our website, Application, or any related services at any time, for any or no reason, without prior notice or warning, and without liability.

 

6. SUSPENSION OR TERMINATION OF USE

We May Discontinue or Suspend Our Services or Terminate Your Use. We reserve the right at any time and from time to time to modify or discontinue, temporarily or permanently, our Sites (or any part thereof) with or without notice. You agree that Footballmentor shall not be liable to you or any third party for any such modification, suspension, or discontinuance of our Sites and Services. In addition, we reserve the right to terminate your access to our Sites and Services for any reason and to take any other actions that Footballmentor, in its sole discretion, believes to be in the interest of our company and of our users as a whole.

7. PURCHASES

If you wish to purchase any product or service made available through our Sites, Services, and Third-party Services (“Purchase”), you may be asked to supply certain information relevant to your purchase, including, without limitation, your credit card number, the expiration date of your credit card, your billing address, and your shipping information.

You represent and warrant that: (i) you have the legal right to use any credit card(s) or other payment method(s) in connection with any Purchase; and that (ii) the information you supply to us is true, correct, and complete.

By submitting such information, you grant us the right to provide the information to third parties for purposes of facilitating the completion of Purchases.

We reserve the right to refuse or cancel your order at any time for certain reasons including but not limited to product or service availability, errors in the description or price of the product or Service, error in your order, or other reasons.

We reserve the right to refuse or cancel your order if fraud or an unauthorized or illegal transaction is suspected.

Some products may offer the option to schedule one or more payments to be automatically deducted from your checking, savings, or credit account (“Subscription”).

If you purchase a subscription product (e.g., a Footballmentor membership), you agree to automatic (recurring) billing and agree to pay the charges made to your account in connection therewith. Your Subscription, and monthly billing of your account, will continue indefinitely until canceled by you. Your Subscription automatically renews on a month-to-month basis, with each renewal occurring precisely one month after you initiate your membership.

Your payment authorization will remain in effect until the programming agreement is paid in full. The payment may be executed on the next business day if the above-noted recurring payment dates fall on a weekend or holiday. In the case of an ACH/EFT Transaction being rejected for Non-Sufficient Funds (NSF), Footballmentor may, at its discretion, attempt to process the charge again within 30 days, and an additional service charge for each attempted and returned NSF will be initiated as a separate transaction from the authorized recurring payment. The origination of ACH/EFT transactions to your account must comply with the provisions of U.S. law. You agree not to dispute this recurring billing with your bank so long as the transactions correspond to the terms indicated here. Failure to continue ACH/EFT transactions to fulfill your purchase results in the remainder of the program cost to come due immediately.

At any time, you will be able to cancel your Subscription with no binding or hidden fees involved. Your Subscription will terminate for the next monthly billing cycle. You will not get a refund for the current/past month’s payment. In addition, you are entirely responsible for canceling your Subscription. If you wish to cancel, you MUST do so through the website: https://lockerroom.footballmentor.com/account/ (Login with your credentials > Menu > Account > View Subscriptions). We do not accept phone or email cancellations. However, we can assist you with the procedure. You can contact us at contact@footballmentor.com.

Prices for our services are subject to change without notice.

We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.

We shall not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the Service.

8. REFUND POLICY

Refunds are offered in relation to individual products or services sold.

Due to the nature of intellectual property and e-commerce law, there are no refunds on digital goods, including but not limited to workout pdf files, programming, or subscription purchases.

For online video call sessions, you will be able to get your booking refunded as a session credit (a gift card of similar value to reschedule your meeting) with a 24-hour notice. There will be no refund if the cancellation is requested after this time or after the session has taken place.

Digital goods/products which are purchased through Footballmentor.com, mypthub.net, or the Footballmentor app are not eligible for return, so are non-refundable. Digital goods refer to any product bought and received and downloaded/streamed virtually, including but not limited to programs, e-books / PDF files, and video call services.

Furthermore, all clearance and special offer items are final sale and may not be returned. No price adjustments will be given on prior sales.

9. PRIVACY

Our Cookie Policies and Privacy Statements apply to any information that we collect about you while you use our Site and Services, that you may provide to us, or that we may collect online and offline.

You acknowledge that the collection, use, storage, and disclosure of your personal information by Footballmentor will be done in accordance with the Footballmentor Cookie Policies and Privacy Statements.

The Footballmentor App (Android application and browser version: footballmentor.mypthub.net) is hosted and serviced by MyPTHub.net. Go to their website to review applicable legal documentation and privacy statements.

10. ACCURACY, REVISION, AND ERRATA

The materials appearing on our websites, services, and other contents could include technical, typographical, or photographic errors. The content is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete, or more timely sources of information. We may make changes to the materials from our Services at any time without notice. We do not, however, make any commitment to update such materials.  Any reliance on the material and content of our Sites and Services is at your own risk.

Footballmentor is dedicated to the continuous evolution of the Services. Please be aware that the Services may undergo modifications, and this can occur without any advance notification to you. Rest assured that these changes are part of our commitment to excellence. Footballmentor will not be liable to you or any third party should there be any alteration, interruption, or discontinuation of our Services.

Fitness and/or nutrition advice is subject to constantly evolving health, nutrition, and sports science findings. Even though we base Footballmentor and our content on current studies and findings, we do not guarantee that they reflect the latest research results or findings. However, we promise to do our best to review and adapt to the latest research and recommendations.

11. DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY AND DAMAGES

WE DO NOT WARRANT OR REPRESENT THAT THE CONTENT ON OUR SITES AND SERVICES: (A) WILL BE CONSTANTLY AVAILABLE, OR AVAILABLE AT ALL; OR (B) IS TRUE, ACCURATE, SECURE, COMPLETE, CURRENT, OR NON-MISLEADING.

INDIVIDUAL OUTCOMES MAY DIFFER. WE DO NOT WARRANT THAT THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE OR OUR PRODUCTS WILL BE ACCURATE OR RELIABLE. THE TESTIMONIALS AND INSTANCES CITED REPRESENT EXTRAORDINARY OUTCOMES THAT SHOULD NOT BE SEEN AS ASSURANCES OR GUARANTEES THAT OTHERS WILL ACHIEVE IDENTICAL OR SIMILAR RESULTS.

YOU AGREE THAT FROM TIME TO TIME, WE MAY REMOVE THE SERVICE FOR INDEFINITE PERIODS OF TIME OR CANCEL THE SERVICE AT ANY TIME WITHOUT NOTICE TO YOU.

OUR SERVICES INCLUDE INTERACTIVE FEATURES THAT ALLOW USERS TO COMMUNICATE WITH US. YOU ACKNOWLEDGE THAT ANY ASSISTANCE YOU MAY RECEIVE USING ANY SUCH FEATURES IS LIKELY TO BE INCOMPLETE AND MAY EVEN BE MISLEADING. ANY ASSISTANCE YOU MAY RECEIVE USING ANY OF OUR SERVICES’ INTERACTIVE FEATURES DOES NOT CONSTITUTE SPECIFIC ADVICE AND ACCORDINGLY SHOULD NOT BE RELIED UPON WITHOUT FURTHER INDEPENDENT CONFIRMATION.

YOU EXPRESSLY AGREE THAT YOUR USE OF, OR INABILITY TO USE, OUR SERVICES IS AT YOUR SOLE RISK. IN NO CASE SHALL DANIEL PAUK, FOOTBALLMENTOR, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, INTERNS, SUPPLIERS, SERVICE PROVIDERS, OR LICENSORS BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING, WITHOUT LIMITATION LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, REPLACEMENT COSTS, OR ANY SIMILAR DAMAGES, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, ARISING FROM YOUR USE OF ANY OF OUR SITES AND SERVICES OR ANY PRODUCTS PROCURED USING OUR SERVICES, OR FOR ANY OTHER CLAIM RELATED IN ANY WAY TO YOUR USE OF THE SERVICE OR ANY PRODUCT, INCLUDING, BUT NOT LIMITED TO, ANY ERRORS OR OMISSIONS IN ANY CONTENT, OR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF THE SERVICE OR ANY CONTENT (OR PRODUCT) POSTED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE SERVICE, EVEN IF ADVISED OF THEIR POSSIBILITY. UNDER NO CIRCUMSTANCES, AND UNDER NO LEGAL THEORY, INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE, SHALL FOOTBALLMENTOR OR ITS THIRD PARTY COLLABORATORS, LICENSORS OR SUPPLIERS, BE LIABLE FOR PERSONAL INJURY OR ANY SPECIAL, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES (INCLUDING, WITHOUT LIMITATION, LOSS OF PROFITS, BUSINESS INTERRUPTION OR ANY OTHER COMMERCIAL DAMAGES OR LOSS, DATA OR USE OR COST OF COVER) ARISING OUT OF OR RELATING TO THESE TERMS OR THAT RESULT FROM YOUR USE OF, OR THE INABILITY TO USE, THE FOOTBALLMENTOR SERVICES AND USER CONTENT VIA THE SITES, SERVICES OR ANY THIRD-PARTY SERVICE, OR ANY OTHER US, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
